If your claim is refused

A refusal is not the end. There is a process to have it judged again.

First, find out why

The refusal notice states why. Common reasons:

• Work connection not established — the link to your job was not shown.
• The accident could not be confirmed — too few witnesses or records.
• Treated as a pre-existing condition.

What you need to supply differs by reason. If it is unclear, ask 1588-0075 to explain.

How to have it reconsidered

• Request a review — ask COMWEL to decide again.
• If that fails, there is a re-examination, then administrative litigation.
• Every stage has a deadline. Miss it and you lose the right to contest, so check the deadline the moment the notice arrives.

Don't do it alone

• Korea Legal Aid Corporation, 132 — free legal advice.
• Migrant workers' support centres — connect you to labour attorneys and help with papers.
• A certified labour attorney — specialists help strengthen the file.
• Posting on the Dasarang advice board lets verified experts respond.

Evidence worth adding

• Coworkers' written statements — that they saw the accident.
• Further medical opinion — a doctor explaining the link to your work.
• Work environment material — what posture, for how long.
