The investigation and hearing

What to prepare
- The attendance notice (text or post)
- Originals and copies of your evidence
- Confirm your interpreter request
- Notes of what you want to ask
An investigation is not a trial. Just tell the truth.
How it goes
- A labour inspector is assigned and contacts you. Try not to miss the call.
- You receive a request to attend. If you need a different date, call ahead.
- Sometimes you are questioned alongside the employer. If that is uncomfortable, you can ask to be questioned separately.
- The inspector hears both sides and decides whether wages are owed.
In a face-to-face session
- Say only what is true. If you don't remember, say so.
- If the employer says something untrue, say it is not true, there and then.
- You don't need to raise your voice. The evidence speaks.
- If Korean is hard, don't answer until the interpreter is on.
If you are offered a settlement
The employer may say "take half and we're done."
- Don't sign on the spot. It is fine to ask for time to think.
- Before signing, ask 1350, 132, or a support centre.
- If the paper says "I will not claim the remainder," you lose the rest for good.
- Never sign a document you don't understand.

A signed settlement is hard to undo. It is perfectly fine to ask for a day.
