Rights that do not depend on your status

Some protections apply to you as a person, even without status. Many people give them up simply because they did not know.

Wages

The right to be paid for work done does not depend on your status. You can file an unpaid wages complaint while undocumented. See the unpaid wages scenario here.

Industrial accidents

If you are injured at work, you have the right to compensation — regardless of status. Consult 1588-0075 (COMWEL). See the work injury scenario.

Emergency care

In an emergency, a hospital cannot refuse treatment because of cost or status. If you are ill, go — don't endure it. 119 is free.

Your children's education

Children can attend primary and secondary school regardless of their parents' status. Ask the school, the education office, or a local support organisation.

If you are a victim of crime

If you suffer violence, sexual violence, fraud or trafficking, you can report it. Victim protection comes first. Contact 112 or 1366.

Reporting itself

Where you report unpaid wages, an industrial accident or a crime, there are arrangements so that reporting does not immediately count against you. Conditions apply, so check with 1345 or a support organisation first.

If you are still worried

Don't go alone — go with a caseworker from a support organisation. They provide interpretation and accompaniment. You can also ask on the Dasarang advice board.
